dc.description.abstractEN: Problem statement: On Ukrainian railways, a significant number of railway traffic accidents (RTA) occur every year. At the same time, in the cases provided by law, the bodies of pre-trial investigation appoint forensic railway-transport investigations. In Ukraine, for the first time among the countries of the former USSR, the forensic railway-transport investigation was organized, expert specialties were introduced, and a number of methodologies were developed. But despite the leading position of Ukraine among the countries of the former USSR on this issue, research methods and organization of their conduction do not correspond to modern European trends. Ukraine's aspiration for EU membership, integration of its railway transport into the common-European transport system states the urgent task of harmonizing the ways of development of forensic railway and transport investigations in Ukraine with the common-European vector of development of the single criminalistic space. Conclusions: Combining forensic railway-transport investigation and the technical investigation of the causes of railway accidents in the research institutes of forensic examinations of the Justice Ministry of Ukraine, which had a number of advantages in the initial stage of reforming the judicial and law enforcement systems of Ukraine, is now becoming an obstacle for further development of both the forensic railway-transport investigation and the methods of technical investigation of railway traffic accidents. Recommendations: As the main direction of development of forensic railway and transport investigations in Ukraine, it is proposed to adopt and develop the experience of European countries, in particular the experience of Poland. It proposes to establish an independent body for investigating railway accidents on the principles stated in the EU Directive 2004/49/EU as of April 29, 2004. This body will be focused on the technical aspect of the investigation. On the institute of forensic experts operating under the Ministry of Justice it is proposed to entrust verification and presentation of the results of the technical investigation of this independent body in the judicial process.en
